This Refund Policy explains how GYB Marketing handles refunds, cancellations, billing disputes, prepaid fees, project deposits, and advertising-related spend in connection with our digital marketing services.

1. Overview § 001

GYB Marketing ("GYB Marketing," "we," "us," or "our") provides strategy, social media management, creative production, paid advertising management, reporting, and related digital marketing services. Because these services involve time allocation, research, planning, personnel scheduling, account preparation, and custom work, refunds are limited and are governed by this Policy together with any applicable Service Agreement or Statement of Work.

By engaging our services, submitting payment, or signing an agreement with us, you acknowledge and accept this Refund Policy. If a signed agreement contains refund terms that differ from this page, the signed agreement will control to the extent of any direct conflict.

2. Non-Refundable Services § 002

Unless expressly stated otherwise in writing, the following payments are non-refundable once work has commenced or once the applicable resources have been allocated:

  • Strategy development, research, discovery, audits, workshops, and planning services.
  • Creative production work including copywriting, graphic design, content ideation, editing, and video production.
  • Time-based consulting, advisory calls, review sessions, performance analysis, and account troubleshooting.
  • Partially completed or fully completed deliverables that have been developed, presented, revised, or prepared for client review.
  • Internal labor, subcontractor time, third-party tool costs, and administrative overhead incurred in connection with a client project.

Digital marketing services are not physical goods and cannot be "returned." Refund eligibility is therefore based on the stage of work completed, costs incurred, and contractual obligations already triggered.

3. Retainer Services § 003

Monthly retainer fees reserve agency time, production capacity, strategic oversight, reporting bandwidth, and campaign management resources for a defined service period. For that reason, monthly retainers are generally non-refundable once the service month has begun.

  • Retainer payments due for an upcoming month may be cancellable only if written cancellation is received before the next billing cycle begins and before related work has started.
  • No refund will be issued for a current active billing period after work, planning, content development, reporting preparation, or campaign management activities have begun for that period.
  • If the client delays approvals, fails to provide assets, or does not use the allocated service capacity during the applicable month, the fee remains due and non-refundable.

Unused service time, unsubmitted requests, or delayed communication by the client do not create an automatic right to refund, credit, or rollover unless expressly agreed in writing.

4. Project-Based Work § 004

For fixed-scope or project-based engagements, deposits and milestone payments compensate GYB Marketing for reserving production capacity and beginning custom work. Accordingly:

  • Deposits: Project deposits are non-refundable once the project has been scheduled, research has started, assets have been requested, or work has otherwise commenced.
  • Progress Payments: Payments tied to completed milestones, draft submissions, revisions, or approval stages are non-refundable once that work has been performed.
  • Client Pause or Abandonment: If a client pauses, delays, or abandons a project after work has begun, amounts paid to date remain non-refundable to the extent of services performed and resources committed.

Where a project is terminated before completion, GYB Marketing may, at its discretion, determine whether any prorated unused amount remains after accounting for completed work, administrative costs, subcontractor fees, and all non-recoverable expenses already incurred.

5. Advertising Budgets & Media Spend § 005

Advertising budgets, media spend, boosted post funds, platform credits, and similar third-party promotional expenditures are non-refundable once transmitted to or committed within advertising platforms such as Meta, Google, LinkedIn, TikTok, or comparable systems.

  • GYB Marketing does not guarantee that third-party advertising platforms will issue refunds for paused, rejected, underperforming, or completed campaigns.
  • Funds spent on impressions, clicks, leads, reach, tests, learning phases, or audience delivery are considered consumed once the platform begins serving ads.
  • Any platform-issued refund, account credit, or billing adjustment remains subject to the policies and discretion of that platform, not GYB Marketing.

Agency management fees are separate from advertising spend and are governed independently under this Refund Policy and the applicable agreement.

6. Setup Fees & Onboarding § 006

Setup fees, onboarding fees, implementation fees, account configuration fees, and similar one-time charges are non-refundable once onboarding has started or internal setup work has begun.

  • This includes account audits, access reviews, tracking setup, dashboard configuration, workflow creation, team briefings, campaign architecture, and strategic initialization work.
  • Even where setup work is not externally visible, it may involve substantial internal labor and is considered earned once initiated.

If a client chooses not to proceed after onboarding work has started, GYB Marketing is not obligated to refund any setup-related amount.

7. Cancellations § 007

Clients wishing to cancel ongoing services must provide written notice in accordance with the applicable agreement. Unless otherwise stated in writing, cancellation requests do not retroactively reverse fees already earned or costs already incurred.

  • Cancellation of recurring services generally applies to future periods only and does not create an automatic refund for the current active service term.
  • If cancellation occurs after work has been scheduled or initiated for an upcoming period, GYB Marketing may retain all or part of the payment necessary to cover committed resources and planned delivery.
  • Failure to communicate, provide materials, or participate in the project does not itself constitute valid cancellation and does not entitle the client to a refund.

GYB Marketing may also suspend or terminate services under the Terms of Service without creating refund rights beyond any amount we expressly determine remains unused and recoverable.

8. Billing Disputes § 008

If you believe an invoice or charge was issued in error, you must notify GYB Marketing in writing within five (5) business days of the invoice date or charge date. The notice should include sufficient detail to identify the disputed amount and the basis for the dispute.

  • Undisputed portions of any invoice remain due by the original due date.
  • Failure to timely dispute a charge may be deemed acceptance of the invoice or billing event.
  • GYB Marketing will review good-faith disputes and may, at its sole discretion, issue a correction, partial adjustment, or explanatory response where appropriate.

Submitting a billing dispute does not automatically pause service obligations, project timelines, or payment obligations for undisputed amounts.

9. Chargebacks § 009

Initiating a chargeback or payment reversal without first contacting GYB Marketing to attempt good-faith resolution may constitute a material breach of our Terms of Service and applicable agreement.

  • We reserve the right to suspend all work immediately while a chargeback is pending.
  • We may present contracts, invoices, written approvals, communications, delivered work, timestamps, and related evidence to contest improper chargebacks.
  • Clients remain responsible for valid fees associated with services rendered, resources allocated, and approved work products regardless of an attempted reversal.

Where allowed by law, we may also seek recovery of administrative costs, collection fees, legal expenses, and other damages arising from improper payment disputes or reversals.

10. Exceptions § 010

Any refund, credit, goodwill adjustment, or partial reimbursement outside the terms stated here is granted solely at the discretion of GYB Marketing and does not create a precedent or ongoing obligation for future matters.

Important Notice: Refund exceptions, if any, may be considered only where GYB Marketing determines in its sole judgment that no meaningful work has started, no non-recoverable expense has been incurred, and no personnel or third-party capacity has been materially allocated to the engagement.

If any discretionary refund is approved, GYB Marketing may deduct amounts attributable to completed work, transaction fees, taxes, platform charges, subcontractor fees, administrative costs, or any other unrecoverable expense before issuing payment.

11. Policy Changes § 011

GYB Marketing reserves the right to modify this Refund Policy at any time to reflect changes in our pricing structure, service delivery model, operational practices, legal requirements, or business processes.

The updated version will be posted on this page with a revised "Last Updated" date. Continued use of our services after changes become effective constitutes acceptance of the revised Refund Policy to the extent permitted by law and any governing agreement.

We encourage clients to review this page periodically and to retain a copy of the version in effect at the time services were purchased.
